I purchased the vehicle pre-owned to find out a year and half later it had structural damage that was not disclosed to me until i had a minor fender bender. I had been driving an unsafe vehicle and now my insurance carrier wants to total the it.

The rear suspension failed in the manner described in the recall: http://www-odi.NHTSA.dot.gov/acms/cs/jaxrs/download/doc/[removed]/rcdnn-09v001-1525.pdf this vehicle had been recalled and checked by the dealer under the previous recall. The actions specified in the recall were insufficient.
